    1. This notice applies to candidates applying for roles at Junkfish.
       

    2. We may update this notice at any time.
       

    3. It is important that you read this notice, together with any other privacy notice we may provide on specific occasions when we are processing personal data about you, so that you are aware of how and why we are using such personal data.
       

  2. WHY DO YOU PROCESS MY PERSONAL DATA?

    1. To run recruitment processes. We may collect your name, address, email address, telephone number, details of your qualifications, skills, experience and employment history, including start and end dates, with previous employers and with us, together with any other information contained within your CV, application forms or other documentation you provide to us. We may also collect information during the recruitment process from a third party such as an employment agency. 

      Our lawful basis for this processing is       Legitimate Interests.
       

    2. To check your entitlement to work in the country of engagement or employment. We may collect your name, address, email address, telephone number, date of birth, gender, passport details and immigration documents, and those of your family if such information is relevant to your immigration status. 

      Our lawful basis for this processing is Legal Obligation and our condition for processing special category data is Employment Law (the processing is necessary for the purposes of carrying out the obligations and exercising specific rights of the controller or of the data subject in the field of employment law).
       

    3. For equal opportunities monitoring. We may collect information about your ethnic origin, sexual orientation and religion or beliefs. 

      Where we are required to collect this information by law our lawful basis for this processing is Legal Obligation and our condition for processing special category data is Employment Law (the processing is necessary for the purposes of carrying out the obligations and exercising specific rights of the controller or of the data subject in the field of employment law). 

      Where we collect this information for our own initiatives our lawful basis for this processing is Legitimate Interests and our condition for processing is equality of opportunity or treatment (the processing is necessary for the purposes of identifying or keeping under review the existence or absence of equality of opportunity or treatment between groups of people specified in relation to that category with a view to enabling such equality to be promoted or maintained).
       

    4. To enter into an employment contract / contract for services with you. We may collect your name, address, email address and telephone number. 

      Our lawful basis for this processing is Contract.
       

  3. WHO DO YOU SHARE MY PERSONAL DATA WITH?

    1. Your personal data may be shared internally with Junkfish staff who need to have access to the personal data you share (as appropriate and permitted by law), such as our People and Talent Team, interviewers involved in the recruitment process, as well as the hiring managers for the role you are applying for.
       

    2. We may share your personal data with third parties to obtain pre-employment references from other employers.
       

    3. We may also share your personal data with third parties for the purposes of business management and planning in the context of a sale of some or all of our business, potential restructuring, accounting and auditing, under a service agreement and/or for the purposes of a transfer of undertakings or where there is a service provision change. In those circumstances, the personal data will be subject to confidentiality arrangements. Processing in this context is necessary to allow effective business planning/decision making and to facilitate management of the business, which is in our legitimate interests and/or enables us to comply with our legal obligations.
       

    4. We may also share your personal data with third parties that process personal data on our behalf, e.g., in connection with our applicant tracking processes.
       

    5. Where we engage third parties to process personal data on our behalf, they do so on the basis of written instructions, are under a duty of confidentiality and are obliged to implement appropriate technical and organisational measures to ensure the security of personal data.
       

  4. HOW LONG DO YOU KEEP MY PERSONAL DATA FOR?

    1. We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements and in accordance with any applicable data retention policy. 
       

    2. In any case, where we determine that there is no longer any requirement to retain your personal data, we will delete that personal data. 
       

  5. Where Do you STORE my personal Data?

    1. We store your personal data on third party servers which are based in the United Kingdom. When working with third parties we may need to transfer your personal data outside of your home jurisdiction.
       

    2. Whenever we transfer your personal data outside of your home jurisdiction, we ensure it receives appropriate protection as required by law. To keep this notice as short and easy to understand as possible, we have not set out the specific circumstances when each of these protection measures are used.   6. What are my rights in relation TO THE PROCESSING?

    1. You may have various rights under applicable data protection laws, depending on your home jurisdiction. This may include the right to:

      1. access your personal data;

      2. correct incomplete or inaccurate personal data we hold about you;

      3. ask us to erase the personal data we hold about you;

      4. ask us to restrict our handling of your personal data;

      5. ask us to transfer your personal data to a third party;

      6. object to how we are using your personal data; and

      7. withdraw your consent to us handling your personal data.
         

    2. You also have the right to lodge a complaint with us or the supervisory authority for data protection your country. In the UK, the supervisory authority is the Information Commissioner's Office. In Singapore, the supervisory authority is the Personal Data Protection Commission.
       

    3. Please keep in mind that privacy law is complicated, and these rights will not always be available to you all of the time

  7. Am I required to provide you with any Personal Data?

    1. Certain information, such as contact details, your right to work in your country of employment / engagement and payment details, must be provided to enable us to enter a contract with you. 
       

    2. Where the processing of your personal data is necessary to comply with a legal obligation, you are obliged to provide all relevant personal data because, if you do not provide this, we may be prevented from complying with our legal obligations.
       

    3. If you do not provide certain personal data, this may hinder our ability to process your application.
       

  8. Is my Personal Data used for automated decision making?

    1. Decisions about the suitability of your application for hiring are not based solely on automated decision-making.
