Hello!
We are Junkfish Games: an independent game development studio with a passion for creating unique, innovative and high-quality games. We are the developers of Attack of the Earthlings, Attack of the Earthlings (mobile edition), Bootleg Steamer, Monstrum and Monstrum 2 and may publish other titles from time to time (the "Games").
We love our Games. We also love seeing the creativity and passion of our community that enjoys them. This Fan Content Policy (this "Policy") explains how you may create, share, and in certain circumstances monetize content that is inspired by or derived from the Games, while helping us to protect our worlds, players, rights and brands. This Policy applies across all our Games, regardless of platform, and may be updated from time to time.

What counts as 'Fan Content'?

"Fan Content" includes any original fan art, fan fiction, cosplay, screenshots, gameplay videos and streams, guides, walkthroughs, mods (for games that support them), and non-commercial community websites or tools that are created using, or otherwise based on, our Games and intellectual property rights.

Key rules

You may create Fan Content based on our Games, provided that you follow all the rules in this Fan Content Policy at all times. We can withdraw this permission (or licence) at any time in our discretion, including if you break any of the rules contained in this Policy.

Fan Content must:
-
Be your own work. Please do not use or extract our original game files, models, textures, music, sound effects, story text, source code, or any other proprietary assets.

Fit the tone and audience of our Games. Do not create content that is offensive, obscene, harmful or that may harm our reputation, goodwill, or communities (as determined by us).

Comply with the law. Do not use third-party assets without permission or a licence. Always respect third-party rights in any included content.

Fan Content must not:
-
Mislead as to its authorship. Do not claim, suggest, or imply that Fan Content has been endorsed, sponsored or granted an “official” status by us where that is not the case.

Be used to promote your own project or online content. You may only use our studio and Games' names and logos in a purely descriptive way, and not, for example, to brand or promote your channel.

Be AI-generated or used in an AI tool. You must not create AI-generated content based on our Games, products, characters, artwork, logos, art style or other distinctive elements of our studio. This includes any training, fine-tuning or uploading of our assets, screenshots, or other protected materials into generative AI models.

If you break any of the rules contained in this Policy, you will lose the permission we have granted you to create Fan Content.. We can ask you to take down any content that does not comply with this Policy, and take other action (including legal action) to protect our Games and intellectual property as we may consider necessary (in our discretion).

Mods, fan-games, and other creations
Mods:-
You can create mods for our Games that support modding (as indicated on the store page and/or description for a Game, where applicable), but you can only do so using the tools and assets that we intentionally make available to you for this purpose. You must, at all times, act in accordance with this Policy when creating mods for our Games.

Mods must not include paywalls, malware, cheats, or methods that compromise gameplay integrity.

Do not unpack, reverse-engineer, scrape, or extract any of our encrypted or proprietary files.

You may not create mods for any Games that we have discontinued (see Paragraph 3.11 below for more details).
Fan-Games: -
You can create fan-games, but only if you first obtain our express written consent, which we will grant or refuse on a case-by-case basis.

If you wish to ask for our permission, please contact us at the email address given in Paragraph 7 of this policy.

We are more likely to grant permission in the following circumstances:

purely “inspired-by” projects that avoid any of the protected elements in our Games.

projects based on the general concept and characteristics of our Games' broader universe, lore and characters (including character personalities and traits) and provided that you develop your own original in-game assets to represent such elements; and
-
projects that do not use or repurpose our in-game character assets or models, storylines, artwork, music, logos, or any other protected intellectual property.

Fan-games must not resemble or be likely to be mistaken for official releases by Junkfish or any persons or companies associated with Junkfish.
Other creations: -
You can create fan art, fiction, cosplay, videos, guides, and similar works based on our Games, provided that they comply with this Policy and community standards and provided that the relevant Game has not been discontinued (see Paragraph 3.11 below).

Please feel free to share, stream, or post your work across social media and content platforms! You may use and distribute screenshots or video capture taken from normal gameplay, except in circumstances where we have made it clear to you that this is not permitted (e.g. pre-release captures or footage that are subject to a non-disclosure agreement or confidentiality provision).
Monstrum 2 and other discontinued Games -
We took the difficult decision to discontinue Monstrum 2 in 2024. You can read more about this on our website at the following link here: https://www.teamjunkfish.com/games/monstrum-2

We do not permit the creation of mods or any other fan content based on Monstrum 2 or any other Games that we cease to support from time to time. This takes precedence over anything else in this Policy.

For the avoidance of doubt, if any audio-visual assets feature in both Monstrum and Monstrum 2, you may use the assets featured in Monstrum to create fan content. You may not create fan content based on any assets that only feature in Monstrum 2 and not Monstrum.

Monetisation rules

You may monetise Fan Content without written approval from us as follows:

Earning platform-based ad revenue from videos or livestreams (e.g., YouTube Partner, Twitch).

Hosting advertising on fan websites (e.g., banner ads).
-
Creating one-off, handmade physical artworks of our characters on a commissioned basis.

However, you must receive our prior written approval when creating commercial merchandise of any kind (physical or digital), including prints, apparel, collectibles, 3D prints, props, and repeated or other commercialised artwork.

You are not permitted to monetise:
-
Paywalled mods or any paid access to derivative content.

Fan-games that use any of our assets, logos, or protected IP.
-
Selling, distributing, or licensing our materials directly.
-
Crowdfunding, paid subscriptions, or donation tiers tied to access to derivative content.

Use of Names, Logos, and Trademarks

You may refer to our company and Games when describing or referencing what your Fan Content is about or what it is based on. However:

Do not alter, stylise, or combine our logos with your own.

Do not use our names or logos in titles, branding, thumbnails, social handles, or domain names in a way that suggests official status or creates confusion.

Do not create lookalike or confusingly similar logos or visual identifiers.

When referring to our company and Games descriptively, you must include a prominent, clear disclaimer as follows:
“Parts of the materials used are trade marks and/or copyrighted works of Junkfish Limited. All rights reserved. This is an unofficial fan work and is not endorsed by Junkfish Limited.”

Ownership and our use of Fan Content

You retain ownership of your original Fan Content. We retain ownership of all our intellectual property, including the intellectual property that forms part of the Fan Content that you may create.

By sharing Fan Content publicly, you grant us a non-exclusive, worldwide, royalty-free licence to use, share, repost, or showcase it (with credit where reasonable) in our community features, promotional materials, and social channels.

You confirm that you created the Fan Content yourself and have the rights to grant this licence to us. The licence continues for already-published uses even if the content is later removed.

Approvals, contact details and enforcement

For approvals in connection with this Policy, please email: marketing@teamjunkfish.com.

We do not proactively search for breaches of this Policy, but we may take action whenever we become aware of misuse in our sole discretion.

If we generally start by asking you to amend or remove non-compliant content, but we reserve the right to request takedown or take any further action if we consider it necessary (in our sole discretion). Failure to act in one instance does not waive our rights.
